These Terms of Use ("Terms") are an agreement between you and {{controller_name}} ("we", "us") governing your use of the SafaChat application and related services (the "Service"). By creating an account or using the Service you accept these Terms.
1. Description of the Service
SafaChat is a dating and social discovery application. It lets adults create a profile, discover other members, match by mutual interest, and communicate through end-to-end encrypted messaging. Parts of the Service are free; certain features require payment (see Section 7).
2. Eligibility (18+)
The Service is strictly for adults. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to create an account. We may verify age and identity and will terminate any account reasonably believed to belong to a minor.
3. Account and Security
You must provide accurate registration information and keep your credentials confidential. One account per person; your account is personal and non-transferable. The Service operates on a single active device basis: signing in on a new device signs the previous device out. You are responsible for activity that occurs under your account and must notify us immediately of any suspected unauthorized use.
4. User Content and Code of Conduct
You are responsible for the content you create and share. When using the Service you must not:
- harass, threaten, intimidate, or defame anyone, or share hateful content targeting any group;
- engage in any form of child sexual abuse or exploitation. This is absolutely prohibited: any such content or conduct will be blocked, the account terminated, and the matter reported to the competent authorities;
- create fake profiles, impersonate others, or engage in fraud, romance scams, financial solicitation, or spam;
- share intimate images of any person without their consent, or threaten to do so;
- scrape, harvest, or bulk-collect data, probe or breach security measures, reverse engineer the Service, or interfere with its operation;
- use the Service for any unlawful purpose.
We may remove content, restrict features, suspend, or terminate accounts that violate these rules (see Section 8).
5. Encryption and Moderation
Messages in SafaChat are end-to-end encrypted: they are encrypted on your device and can only be decrypted on your counterpart's device, and our servers cannot read message content. Safety features still apply: the app can flag a conversation for review based on on-device keyword matching, and when a user submits a report, the reported messages as decrypted on the reporting user's device — together with screenshots where provided — are transmitted to our moderation team. We store communication metadata (who communicated with whom, when, and connection information) as described in the Privacy Policy. Profile content (photos, bio) is not end-to-end encrypted and is subject to moderation, including automated screening.
6. Intellectual Property
The Service, including its software, design, and trademarks, belongs to us or our licensors. You retain rights in the content you create; you grant us the limited licence needed to operate the Service (for example hosting your profile photos and delivering your encrypted messages). You may not use our trademarks without written permission.
7. Paid Features
Certain features (such as premium subscriptions, boosts, or credits) are sold through the app store of your device. Prices are shown before purchase; billing, renewal, and refunds are handled under the applicable app store's terms and mandatory consumer law. Unless required by law, payments are non-refundable and unused paid features expire when the account is deleted.
8. Suspension, Termination and Account Deletion
We may warn you, restrict features, suspend, or permanently ban your account if you breach these Terms or applicable law, with the severity matched to the violation. You can delete your account at any time in the app; deletion is completed after a short grace period during which you may cancel. Some records are retained after deletion where the law requires or permits it (for example consent records and communication metadata), as described in the Privacy Policy.
9. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available". We do not run background checks on members and are not a party to interactions between members; exercise caution when meeting people online or offline. To the extent permitted by law, we disclaim implied warranties and are not liable for indirect or consequential damages; our total liability is limited to the amount you paid for the Service in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited by law.
10. Governing Law and Disputes
These Terms are governed by the laws of {{governing_law}}. Disputes are subject to the jurisdiction of the courts and enforcement offices of {{jurisdiction}}, without prejudice to mandatory consumer protection rules that let you bring claims in your place of residence.
11. Changes to These Terms
We may update these Terms. For material changes we will notify you in the app and, where required, ask you to accept the new version before continuing to use the Service. The current version is always available in the app and on our website.
